(smile) ############################################################ 4. Some more equal in law than others? - Yvonne McCalla Sobers ############################################################ From: "Yvonne McCalla Sobers" Subject: Press release: Some more equal in law than others? Date: Mon, 19 Apr 2004 09:10:10 -0800 [headings deleted] Some more equal in law than others? Policemen seem more equal than citizens, and some policemen seem more equal than others in the Jamaica Constabulary Force. As long as the Animal Farm practices continue in our justice system, so long will peace and good order evade our country. The public observes that some policemen can be arrested and jailed, even before a ruling is received from the Director of Public Prosecutions. A policeman was swiftly taken into custody last month in Negril when he was accused of assaulting a tourist. Far more typical, however, is the favoured treatment meted out to the six policemen charged with the multiple murders at Crawle: their arrest has been delayed till a time convenient for bail application. On the other hand, ordinary citizens are routinely jailed for weeks in sub-human conditions without the option of applying for bail, while police investigate to find out whether evidence exists for laying charges. Arrest without charge breaches the Jamaican constitution as well as international human rights conventions. Yet the state seems unwilling or unable to stop the unlawful arrest and imprisonment of civilians against whom not even the most minor charges have been preferred. Families Against State Terrorism (FAST) warns of the difficulty in convincing a cynical public that the justice system is structured to deliver justice to the ordinary Jamaican. Indeed, more than 300 Jamaicans are killed each year when people take the take the law in their own hands. FAST is deeply concerned at the seeming absence of political will to ensure that all have assurance that they will be considered equal before the law - ordinary citizens, tourists, and policemen. Power and privilege cannot continue to displace law as the expected norm, without further dire consequences for this country. We demand therefore that the Commissioner of Police legally justify the privilege accorded to Senior Superintendent Reneto Adams, a corporal, and four constables in the execution of the arrest warrants for murder. April 19 2004 -------------- [] RESPONSE [] -------------- Yvonne, we are going to have one of our rare arguments here, becuase I believe that a police officer must be treated very differntly from the regular citizen; while not violating any sense of fair play! The police put their lives on the line each day in order to protect the rest of us and they confront the worst in the society every day. They handle OUR rapist, burglers, swinglers, prostitutes, dons, drug users, abusive motorist, etc. Therefore we should not be to quick to throw them in with these persons as soon as they are suspected of a crime! We need to give them latitude becuase they confront the grey areas of Jamaican life. I am happy that Adams and team are going to court. Hopefully they will have a chance to prove that they were doing GOOD police work at Crawle. If they fail, then I hope they go to prison like other criminals! In the mean time, becuase of the role they played in bashing criminals, I can live with the little more respect they get......as long as mi get my fair share when my turn come.
