The fires have not stopped despite the rains and the promises from the authorities to take action. At the start of this week the foul air reached as far as New Kingston (some 3-4 miles away), and today visibility at Tynson Pen was less than 1/2 km. Again, I call on the citizens of Jamaica to "bawl out" to their political representatives so that they will have the political incentive needed to address the fires a as a NATIONAL CRISIS! In the 1940s the sugar cane estates in the South St. Catherine area released 'dunder' (sugar processing pollutants) into our rivers and swamps. Thousands of creatures were killed and washed up on the shores. Here in Portmore this was the beginning of the end for our rivers and the Dawkins Pond. Today the waters of Portmore area are a desert. low on fish (and other sea creatures such as Conch). Our representative of the 1940s, Mr. Rose, raised vigorous objections in the halls of power! He accused the authorities of bias my failing to prosecute the huge estates. We started killing the rivers in the 1940s... today we turn to the air! People, we must take care of our only home. Portmore goes to court..again - Gleaner - Dionne Rose ############################################################ http://www.jamaica-gleaner.com/gleaner/20050419/lead/lead4.html New Portmore lawsuit - Citizens mount challenge to Highway 2000 route published: Tuesday | April 19, 2005 Dionne Rose, Staff Reporter GOVERNMENT HAS been slapped with another lawsuit challenging the Portmore leg of Highway 2000. The application was filed yesterday in the Supreme Court on behalf of the Portmore Citizens Advisory Council and the Portmore Joint Citizens' Association. The lawsuit is the second one to have hit the administration. The first was filed last month on behalf of five Portmore residents, including Jamaica Labour Party (JLP) Councillors Natalie Campbell-Rodriques, Andrew Wheatley and Keith Blake. Gifford, Thompson and Bright, the attorneys-at-law representing the council and the citizens' association, are seeking leave to apply for judicial review and leave to extend the time for applying to quash the Toll Roads Order of 2002, which was made by the Minister of Transport and Works in March 2002. According to the firm, if leave is granted, the organisations would be entitled to proceed to a full hearing before the Supreme Court, at which they will ask the court for (a) an order quashing the minister's order in so far as it relates to the Portmore section of Highway 2000; (b) a declaration that the designation to the Mandela Highway as an alternative route is unlawful; (c) and an order prohibiting the minister from making a toll order in respect of the Portmore section. COUNCIL, CITIZENS ARGUE The council and the citizens' association are arguing that under the Toll Road Act, there must be an alternative route "in the area in which the toll road is to be established". They also pointed out that the alternative route is in a quite different area, and is more than twice as long in distance. The Reverend Barrington Soares, chairman of the Portmore Citizens Advisory Council, and Carol McLean, public relations officer of the Portmore Citizens' Association, swore affidavits in support of the application. In his affidavit, Rev. Soares said that when he heard in 2004 that the existing route across the causeway was being taken away, he found it "most strange, since my belief had been that when a toll road is built and operated between two places, the former non-toll road should be kept in existence for the use of those who cannot afford the toll, or choose not to pay, or who are not permitted on the toll road". Ms. McLean also noted, "While residents were not opposed to a toll, they were opposed to the imposition of a toll with no acceptable alternative route." Regards ******************* Webmasters Comment ******************* portmore_tollinfo, As you know I am in support of the Citizens Protest since 'forcing' people to use a toll road is immoral unless there is good justification for it. Indeed, the arrogance of some officials to the reasonable questions of the residents is nauseating and infuriating. In spite of all this, I am not convinced that the government meant any harm by presenting to us the toll road. I just feel they "over sold" to the investors. This is why I am also supportive of government officials coming to Portmore to explain their actions to the people... even in an angry public session. If a government has good reasons for taking action, it must face the people with these! I have passively supported the protest efforts in the hope that all sides would eventually come together to reach an accommodation that we all can all live with... I believe we should work things out and I am NOT sure that going to court is the best idea. In the court we have a ‘lose lose’ situation! No one will win in the end since di highway thing gone bad already! Another side to the problem is that the whole matter has become too very partisan for me. On one side you have PNP loyalist saying that persons are against development; while the JLP are saying that the government just want to make the highway profitable at the expense of Portmore residents. I will never call what is wrong as "right", but as a loyal member of the PNP I am placed in an uncomfortable position between warring parties. (Fortunately the PNP is reasonably tolerant of divergent views... but mi nuh want to test it too much! (laugh) Ignoring the politics, I am still proposing that we form a "Highway Users Association" (HUA) to: 1) Secure and police the rights of all Highway users 2) Ensure that all the benefits to Jamaica are realized 3) Act as a lobby group to keep toll rates low 4) Negotiate for a special rate for Portmore residents I am also proposing that since the highway in Portmore is a replace road the rate at the toll gates located at Fort Augusta should be especially reasonable (compared to the rest of the highway). If not, then at least one booth should be 1/2 price during peak hours. This would ensure that the poorest among us still have access to Kingston. Is anyone out there willing to join me in this? It is one of the three umbrella citizens association groups in the municipality. The aim is to unite the 19-24 citizens associations of Greater Portmore to speak and act in unity fo rthe development of the community. While the Council should monitor each association under its charge, each association is autonomous and is more answerable to the local citizens. I wonder if this is betraying that Ken believes that Portia Simpson will indeed win the race to be come the leader of the PNP, leading to her eventually becoming Prime Minister of Jamaica? D'you thing it'll happen Ken? To Kevin from Kennedy... My statement in the newsletter was NOT a Freudian slip, I was trying to be "politically correct" by using a female reference. English is such a poor language... Well, I think Portia has a 60% chance of becoming the next leader of the PNP, (but a 40% chance of becoming an elected Prime Minister). The PNP delegates (like in all parties) are very concerned about finding a winning candidate and Portia has this advantage over her rivals. If I had my way, the first woman prime minister would be Maxine Henry-Wilson. She is bright, qualified and knows how to win. I have seen her in action and she engenders loyalty. I really think she would do Jamaica proud! Pity she is not running, I would join her camp. I worked hard to become a PNP delegate as I wanted to have a vote at the next PNP Conference deciding the next Prime Minister. But I failed to meet the over 30 articles of the PNP Constitution that one must meet to have a voting PNP group. Additionally, the National Executive keeps adding more guidelines! If I wanted my PNP groups to have a vote I would have to lie to the party about my numbers and meetings... For example, much drama attended the setting up of the Gun Court in 1974, following societal panic after two high-profile murders. The promise of this new court was that it would reduce gun crimes because “It red and it dread”. The dramatic approach may have helped ease anxieties at the time, and certainly gave a sense that something was being done to ease public anxieties. However, murders have escalated since that time, moving from about 200 in 1974 to nearly 1,500 in 2004 with the possibility of further increase in 2005 if present trends continue. The recent drama is the razor wire confinement closely resembling a concentration camp as part of a 96-hour curfew of a community said to have connections to criminality. This was yet another move, according to a government spokesman, to do something different from what has been done before. Earlier dramas have included about 14 new and later disbanded police units, at least one headed by a leader in fancy dress. There have been year-long curfews yielding no significant arrests or seizure of weapons. Finds of weapons and cocaine have been televised and photographed, with no sign that the criminal importers have been detected. The work of policing is too slow and dull to hold media interest during the process. Unlike the impression created by television series such as CSI, investigation cannot be packaged into the hour available for viewing. Security forces are expected to show their professionalism with results, not media footage. So what the public needs is not the rows of razor wire confining in a dust bowl in the hot sun almost 100 young men, most of whom are returned home after being “processed” for 12 or 15 hours. The public ought to demand the quality of investigation in which the police have done enough homework to know exactly whom they want, what bars they drink at, where they play dominoes, what women’s houses they sleep in, where they have hidden the contraband, and where they are likely to escape to till the heat is off. When the security forces cordon off an area, they lose credibility if they then scrape up at random the men of arms-bearing age, showing the security forces really do not know whom they want. The police alienate their best allies - residents of communities in which criminals are believed to take refuge - if they enter with the aura of an invading force. Time has shown that gun crimes have continued to increase despite the hopes invested in the Gun Court because “It red and it dread”. Randomly picking up scores of persons has not built public confidence in police investigative capacities. Those who flout the law must know that the police are competent enough at their work to identify wrongdoers and catch them so they can be punished according to law. Security seemingly based on garnering media attention and on trampling the rights of others is a short-term illusion.
