JS I need some advice. I live in Greater Portmore and for the last month every Friday, Saturday and Sunday night I have been disturbed by “Music” being played at a two storey shop on the Old Braeton Road, the location at which a teacher was shot and killed sometime ago. For the last four weeks my husband and I have called the Greater Portmore Police to complain. Sometimes they send a patrol car to stop these people, other times they ignore our request. From my understanding of the Noise Abatement Act persons who intend to operate any specified equipment to provide music for dancing or any other form of entertainment in a public place in circumstances where such music is reasonably capable of disturbing any person occupying or residing in any private premises, such persons shall make a written application to the Superintendent of Police in charge of the Division will be held for permission to do so. Also that such persons causes annoyance to any person within the vicinity between 10pm and 6am and refuses to reduce the noise level, a criminal offence has been committed. I need to know: 1. Has the Superintendent for the Division (Dent) granted these people permission to operate a dance every Friday, Saturday and Sunday night? 2. Provided the Superintendent has granted these operators permission, having called each night for the last four weeks, and requested the police assistance does their continued annoyance constitute a breach of the conditions under which such permission was granted? 3. What can I do to stop these people from preventing me from enjoying my property in peace and quiet?
